1. General:
   1. ‘Refer & Earn’ is a referral scheme that offers members the opportunity to earn a bonus for referring people they know to TopCashback UK. The scheme is governed by these Terms & Conditions (“T&Cs”) in addition to our standard Terms & Conditions
   2. When promoting TopCashback using a referral link, you should make it clear that you will receive a reward for the referral.
2. Eligibility:
   1. Refer & Earn is open to all TopCashback UK members of good standing i.e. your TopCashback account has not been restricted or deactivated.
   2. Refer & Earn is intended to be used by individuals to promote TopCashback to people they know. We reserve the right to restrict referral bonuses or deactivate your account in cases where this is being abused.
   3. If you promote or intend to promote TopCashback to a wider audience using the referral scheme, you will be bound by the additional terms in section 7.
3. How The Scheme Works:
   1. You will receive a referral bonus if:
      • The person you refer clicks on your unique ‘Refer & Earn’ link and signs up to the site on that click-through.
      • The person you refer authenticates their TopCashback account
      • The person you refer meets the cashback earnings or spend requirements (“Threshold”) stated in the promotion terms and conditions.
   2. The referral bonus amount and qualifying time period is subject to change. The bonus you receive will be the amount that was advertised on the site at the time the person you referred signed up from your link, which may be different to the amount offered when you sent the link to the person you are referring or when the bonus was applied to your account.
   3. The referral bonus you will receive and the time the member you referred has to reach their threshold will be shown on your account, Refer & Earn > Your Referrals page.
   4. The referral bonus will become Payable when your referred friend’s cashback is confirmed.
4. Exclusions and Limits:
   1. Only referral bonuses for genuine sign-ups will be paid. We will not pay the bonus for any referrals where the new account has been terminated. Multiple accounts created for use by the same person or any fraudulent sign-ups may result in termination of your account and all accounts which we deem to be linked.
   2. Your referral link should not be promoted by you alongside any other new member incentives, unless expressly permitted within the promotion Terms and Conditions. Referrals where more than one promotion has been earned against the same sign-up may risk having a bonus or incentive removed.
   3. Refer & Earn bonuses will only be payable by Bank Transfer, unless explicitly stated otherwise as part of any other promotion.
   4. Cashback which is awarded as goodwill, incentives or contest cashbacks will not be counted towards reaching the eligible threshold for both Refer & Earn sign-up bonuses and Referral bonuses.
   5. The following transactions will not count towards your friend’s referral threshold:
      • Additional sign-up bonuses,
      • Bonus promotions,
      • New Member Deals; and,
      • Cashback awarded from the list of excluded merchants in section 8.
5. Representations:
   1. By participating in Refer & Earn, you represent to us:
      • When sending a direct message or email communication, you have, where reasonably practical, obtained consent from the recipient to receive this type of marketing communication
6. Prohibited Activities:
   1. The following activities are not permitted:
      • Impersonation of TopCashback or pretending to be a representative of TopCashback and making false claims relating to any rewards that may come as a result of signing up to the site.
      • Self-referral
      • Using your referral link in search engine sponsored listings (e.g. Google Adwords) or any other paid advertising without the prior permission of TopCashback.
      • Using Iframes as a way of generating referrals unless expressly permitted by TopCashback.
      • Misleading or attempting to mislead anybody in connection with the Refer & Earn referral scheme.
7. Posting in the public domain (inc. Influencers):
   1. If you are a content creator or influencer, you should consider registering for our separate affiliate program - ui.awin.com/merchant-profile/2459
   2. The following additional terms apply if you promote or intend to promote TopCashback via the Refer & Earn to a wider audience (e.g. on forums, message boards, blogs & social media).
   3. If promoting TopCashback in a commercial capacity, you must ensure you clearly display relevant advertising disclosures (e.g. #ad).
   4. You should not promote cashback on a financial product (including current accounts, ISAs, insurance products, credit cards, loans, Buy-Now-Pay-Later and mortgages), without prior permission from TopCashback. This does not impact you promoting to family and friends you know.
   5. If choosing to promote TopCashback on your own website:
      • You must include an option to consent to cookies, a cookie policy and a privacy policy.
      • Refer & Earn scheme uses cookies to allow TopCashback to record referrals and be able to correctly allocate the reward and thus, by including on your website you’re allowing TopCashback to record their sign-up in relation to your referral.
      • Refer & Earn invites should only be sent via electronic communications if you have the consent of the recipient.
